Terms
01 WebMovies.TV is a branding style of Aquila Digital Limited, Registered Office - Suite 201, Sunbeam Studios, Sunbeam Street, Wolverhampton WV2 4PF, United Kingdom. Registration Number 6383411 Registered in England and Wales.
02 Through the branding style of WebMovies.TV, Aquila Digital Limited will provide professional video / movie making services as offered and detailed in the www.webmovies.tv website.
03 Deposit. The client will be required to pay a studio booking deposit of £250 upon receipt of Aquila Digital Limited invoice. The deposit will be deducted from the final full production invoice total on completion of the project.
04 Booking Cancellation - Should the client cancel the agreed booking within 7 days of the agreed booking date the client will forfeit the deposit. Should for any reason the booking be cancelled at any time by Aquila Digital Limited the deposit will be refunded in full - however Aquila Digital will not be held responsible for any subsequent consequential loss to the client or agents of the client.
05 All virtual sets templates including all stock background video sequences and stills imagery offered for use within the virtual sets templates will remain the property of Aquila Digital Limited.
The client will be allowed to use the set template of choice in the clients’ video presentation and in the clients' own website for an undetermined period, but the client will have no claim to ownership or copyright of that set template or any Aquila Digital stock footage or imagery contained within the final video.
06 While the client will retain copyright of content in video footage of the client and clients’ presentation taken against green screen material at Aquila Digital Limited studios, Aquila Digital will own and retain the original tape. The client agrees to pay Aquila Digital a fee of £100 for any copy of the original green screen, un-cut video footage should it be required.
07 Any other additional services required in support of the productions offered under the WebMovies.TV Series packages ie., additional video ⁄ movie production, presenter and ⁄ or voice over artist, editing techniques, animations, stills photography, illustration, graphics and original sound, will be quoted and charged for at full Aquila Digital Limited rates and subject to the full Conditions of Supply of Aquila Digital Limited. A copy of these conditions is available upon request.
08 It will be the responsibility of the Client to ensure that all materials presented for video reproduction are free from any third party claims for breach of copyright or license.
09 After green screen video footage of client / presentation has been produced at Aquila Digital Limited studio, the client will be shown and select clips from the raw footage directly from the camera - ie., no pre-editing, colour or sound balancing in any way, - the client will then be required to sign an Aquila Digital ‘Approval for Edit’ document, which will detail the full requirement of the production and full costs as agreed. The client agrees that signing this document is an instruction for Aquila Digital to proceed to final production of the project as detailed in the document and from there on the client is responsible for full settlement of the account on time and on receipt of a watermarked low resolution file (in QuickTime format) for checking.
10 Production Cancellation. After green screen footage has been produced and the project is ready for edit stage, the client will have 24 hours from date and time of signature on the ‘Approval for Edit’ document to suspend or cancel the project, but agrees that should for any reason suspension or cancellation be instructed, the client agrees to pay a £250 cancellation fee within 7 days of receipt of invoice in addition to forfeiture of the original £250 studio booking deposit.
11 The client agrees that any client amendments or alterations contrary to the instructions detailed in the signed ‘Approval for Edit’ document will incur additional fees based on a fee structure of £100 per hour.
12. Upon completion of the project the client will settle the account in full within 7days of receipt of invoice.
Upon receipt of payment in full Aquila Digital Limited agrees to dispatch either electronically or on disc (by post) a predetermined, final formatted file of either - a high quality 512pxl x 288pxl Flash file (progressive download), ready for embedding directly into the client’s website - or a High Definition QuickTime file suitable for streaming into the client’s website from YouTube.
The client agrees that additional copies and / or other files sizes and file formats will incur additional costs.
13 The client shall indemnify Aquila Digital Limited against any actions which may arise from any material introduced or claims made by the client in the final video production.
